lama sudah tidak mengupdate blog kesayangan ni...
sibuk dengan kerja...
dan sekarang kontrak kerja pun dah tamat dan here come classes!
kini saya memasuki semester 7 diploma Analisis Pelaburan di UiTM Segamat...
harap-harapnya boleh memperbaiki keputusan dan menaikkan CGPA...
berbekalkan ubat dari doktor pakar, semoga semester ini dilalui dengan lebih sihat...
bila difikir-fikir, ada kesayuan di situ...
kawan-kawan lain dah grad, kita masih tersangkut dekat sini...
tapi sebenarnya ramai lagi diuji dengan dugaan berat berbanding saya...

Minggu lepas, semasa masih berkhidmat di pejabat Hal Ehwal Pelajar, seorang adik junior ni datang untuk mendapatkan cop HEA dan itu adalah cop terakhir untuk diisi di dalam borang BERHENTI. Adik ni bakal berada di semester 6 iaitu semester terakhir diploma dengan permulaan semester baru ini...

Dia telah menerima surat daripada pihak UiTM yang kemungkinannya isinya memberhentikannya..jadi dia datang ke uitm untuk membuat clearance dengan mengambil segala cop pengesahan daripada bahagian-bahagian di dalam UiTM ni...
Saat dia hendak melangkah pergi kami bersalaman, berpelukan erat....bergenang air mata lalu ditahan-tahan tatkala nampak genangan air matanya....tidak mahu menambah hiba topik perbualan di ubah...berat mata memandang, berat lagi bahu yang memikul...saya hanya mampu katakan kepadanya "kuat ya"....hanya itu...kerana saya sendiri amat lemah dalam menggagahi ujian yang diberiNya...

sekali-sekala merenung nasib diri, saya akan mengenang dirinya yang jauh lebih berat diuji kerana terpaksa diberhentikan...lalu kembali semula semangat dalam diri untuk meneruskan perjuangan di medan ini...

biasalah bila dah extend ni, penginapan kena cari sendiri sebab dah tak dapat kolej( kolej hanya layak untuk pelajar diploma sem 1-6 sahaja dengan syarat aktif aktiviti kolej mahupun kampus ), kena juga kerja part time bagi menanggung pengajian kerana pinjaman ptptn telah tamat...juga kena fikirkan pengangkutan keluar masuk kampus...
buat masa ni saya masih duduk di kolej kerana sepanjang tempoh SKP kami diberi kemudahan kolej dan sedang menunggu permohonan rayuan kolej...jika berjaya saya dapatlah tinggal di dalam tetapi dikenakan bayaran sebanyak rm 210 untuk satu semester...ok lah tu daripada rm 100 sebulan kalau menyewa di luar...

hidup ini bila memandang orang yang lebih senang serba serbi memang cemburu...
tapi bila memandang orang yang lebih susah...alangkah beruntungnya diri ini...
Aku bersyukur ya Allah..
Aku redha ya Allah...

Student Service Scheme Truly Helps Students of UiTM

In the labels: The Story of My Life

I am now doing Student Service Scheme or Skim Khidmat Pelajar among tens of other student..mostly are the extended student. This programme is made by the university to help students get financial sources to continue their study and at the same time helps them to do the administration works.. some of us were placed at the college office, sports office, and as for me, i am placed at the Students Affair Office or Pejabat Hal Ehwal Pelajar..

When I first started on 10th of October 2011, i was placed at one of the college offices (Sector A).but on the second day i was severely sick. i was vomitted for 7 times! I messaged kak Nad, one of the clerk in the office and she told the manager, Puan Zalina Hitam whom we preferred called as Bonda or Mum. She was worried about my condition and called Mr Mohd Faizul, the deputy registrar and he then transferred me to the HEA offices..

Well...quiet sad there...because I already love the environment and the people at the college (hostels) office..
But Bonda did it because UiTM Johor will be hosting the KARISMA stands for Karnival Sukan Mahasiswa..the sports carnivale for all uitm students with 4800++ participants..for your information, uitm has more than ten branches..i dont remember the number..and the contingents will be staying at the hostels...therefore a lot of works await! So, its better to send me to another department then to let me suffer because of my poor health condition and at the same time hinder the working progress..

On the other hand, I managed to stayed at the hostels in Sector C..with other students making the SKP and the Bachelor students, whom payed for a rented house but the house isnt ready...it is the outsiders contractor and not the UiTM project....but the admin was so kindhearted that they let these unlucky students stay at the hostels..
together, there are 15 of us...

Eventhough it is called the SKP, but we do works like the other staffs...we do the clerical works..
Well there are a lot of confidential issues that I have to keep my mouth zipped...
And there are also a lot of things that are prohibited for me to do because I am still the students of this beloved campus..

We were paid RM 4 per hour and our working hour is 9 hours per day; from 8:00 am till 5:00 pm..so you do the math ;-))

With the money I earn, it can help me to pay for the fees, and make living here with increasing life costs..
and at the same time gives me working experiences...it will helped me a lot before I entered the real working life...

Life Is Tough

Tuhan, usah bebankan kami yang tidak terdaya...maafkan salah kesilapan, 

ampunkanlah dosa-dosa, rahmatilah kami...

this is the point that i'll cry deep in my heart or sometimes it tears out...

especially when i've been facing problems...

for now i am having hardship in performing my obligations to fast during Ramadhan and to study, doing assignments and stuff..especially i am now in semester 6 diploma in Investment Analysis; 

got project paper to do...it is now in the last stage...

for the whole week; not a single class i've been to...

i am suffering now for my gastric...

the smiling me~its hardly to smile nowadays~

ive been crying a lot..O Allah..

i accept the pain that You gave me...

for that I hope my sins is forgiven by You....

and I hope that there will be a better tomorrow for me..

Despite that i am trullt thankful to Allah because there are still people that care for me..

Yesterday the sisters in Permas took the break fast food for me

they even took two! thinking of nobody takes for me yet

but sadly I couldnt  eat that..

it is curry and spicy chicken...

i just break fast drinking soy milk

and slept after that

~so weak for holding the pain and crying a lot the whole evening~

today i've been given a medicine by Cikgu Halim; Medical Attendant at UiTM Segamat named Histac 150mg (Ranitidine Tablets)

he also bought me a full plastic of Chipsmore and boxed milks and Milos....

I want to pay for that; but he refuse the money...

may Allah pay his kindness with al Jannah... 

Kolej Baru!

Bismmillahirrahmanirrahim..
Alhamdulilllah...dah masuk kolej akhirnya..kat sini kolej di maksudkan sebagai bilik ye a.k.a asrama.. Kolej di Sektor A, iaitu Kolej Suluk Berlingkung (SB). Sektor A ni adalah kolej lelaki. Jadi hendak dinyatakan di sini bahawa kami tinggal tak jauh je dengan pelajar lelaki UiTM Segamat ni....Kolej ni ada 4 blok, yang mana dua di bahagian depan pelajar lelaki tinggal dan dua di bahagian belakang, kami; the ladies..sebelah menyebelah tak sampai 10 meter pun kolej siswa dan siswi..


Pelajar perempuan semuanya semester 6 dan pelajar lelaki bercampur....kebanyakannya memang dah tinggal dekat luar sebab polisi Unit Pengurusan Kolej ialah pelajar lelaki sem 4 ke atas tak layak dapat kolej..tapi bergantung pada syarat-syarat tertentu...


mulanya saya dapat blok B, tapi entah kenapa seseorang dah  masuk dan letak cadar dia siap2 kat katil yang sepatutnya jadi katil saya...lepas tu ahli bilik tu dua orang masuk, dan saya tegurlah, tapi diorang macam hairan je tengok saya..sebab saya duduk dekat katil kososng yang telah dicop orang lain. Siapakah??? 


huhu...dia pun penghuni asal bilik itu...bila dia masuk dan lihat saya di situ tiba-tiba dia jadi hangin, macam nak mengamuk pun ada...tapi kalau orang jadi api, kita la kena jadi airnya..takpelah; buang ego jap; cool-kan dia and then ajak dia pergi solve problem ni kat kaunter pendaftaran...patutnya dia pergi sendiri da boleh dah....

Barulah tahu, bila si pemilik cadar mengaku dirinya dan mahu menukar bilik..lepas tu bermula la adegan rayu-rayuan, pujuk memujuk supaya saya sudi bertukar bilik dengannya. Well, bilik sekarang pun macam saya tak selesa je disebabkan attitude seseorang yang hangin tak pasal tu, jadi apa salahnya kan? Tapi kena tengok roomate jugak dulu.ok ke tak. hurmm...kemudian dia( Su) hubungi orang itu, kami pun menjejaki si dia dan oh!! Nur Azyan rupa-rupanya, my fren yang amik Diploma Accounting! Straight away saya setuju..!


Hari dah makin petang, dan saya kembali ke P.I untuk solat. Lagi pula arah kiblat di kolej baru ni tidak ketahuan. Singgah sebentar di benteng Taming Sari untuk beli makanan..perut sudah berkeroncong nampaknya, dan ia tidak boleh lambat diisi, kalau tidak perlu diisi dengan tiga jenis ubat sekaligus karang...tak mao!!!


Petang sikit, Alhamdulillah ada seseorang yang saya ibaratkan ibu saya di UiTM ini; sudi menolong saya mengangkat barang-barang saya. Seorang pensyarah di sini yang baru menunaikan Haji tahun lepas-semoga Mabrur ya Allah!- hatinya begitu baik dan mulia. Hanya Allah yang boleh membalas segala kebaikan dan kasih sayangnya kepada saya. Saya? belum tentu mampu...




then...my lives in the new college begins!Bismillahirrahmanirrahim


Ps:: dalam hati kerap kali merintih agar Allah kurniakan roomate yang baik dan solehah, serta mentaati perintahNya..tak sanggup rasanya mengulang sejarah semester lepas...ketiga-tiganya tidak solat dan menutup aurat... masyaAllah! Nauzubillah....bagaimanapun mereka tetap di dalam doa ini agar Allah kurniakan hidayah...Amin ya RAbb!

Riadah Bersama Yang Tersayang

Pagi semalam, lepas solat subuh berjemaah di masjid as-syakirin uitm segamat, dan selepas membaca al-ma'thurat dengan adik-adik, dan mendengar sedikit tazkirah dari kak Rabiatul Hasanah Muhammad Nasib a.k.a kak Hasan, saya menyampaikan perancangan saya pagi itu iaitu untuk strolling. Saya ajak adik-adik join sekali. Tapi ada yang tak dapat sertai, misalnya adik-adik sem 1 yang ada modul. Kemudian Siti Aisyah Muhd Mustaffa, dip information management sem 3; kata yang Ruby( Nik Siti Robiah Mohd Ali) dah tempah basikal untuk beriadah pagi ini. Alhamdulillah, meriahla jugak aktiviti pagi ni. Kemudian aktiviti kedua yang dirancang ialah membasuh telekung Masjid As-Syakirin ini. 

Pada mulanya saya, kak Hasan, Intan dan empat orang adik-adik pra-diploma perdagangan berjalan-jalan dahulu, sementara Aisyah dan Shira pergi mengambil basikal yang ditempah. Kami bertujuh bermain-main sebentar di taman berdekatan masjid dan membuat pertandingan siapa paling lama dapat bertahan di tiang besi, main jongkang-jongket dan kemudian mula berjalan ke tempat lain pula tapi tak lama kemudian saya ajak Intan untuk berjoging. Peluang diambil dengan niat untuk mencergaskan badan yang selalu sakit-sakit ni dan yang makin bertambah-tambah lemak...:-(( dalamberjoging tu Intan yang duduk luar menceritakan sebuah kisah seram yang pernah dilalui oleh seorang pensyarah lelaki baru semasa baru melaporkan diri di sini...

Oleh kerana tiada tempat tinggal, beliau ditempatkan di villa yang sedang kami lalui ini...villa ini terletak berhadapan masjid sahaja yang sekarang dihuni oleh penuntut lelaki yang dapat kolej, tetapi tiada bilik (tak cukup bilik). Kata Intan, sewaktu lecturer tu nak tidur, dia hendak menutup pintu bilik, kemudian nampak satu makhluk yang tiada wajah dan badan hanya sampai ke pinggang sambil memegang kek. Makhluk tu nak bagi lec tu makan kek tersebut. Kemudian lect tu baca ayat2 suci dan kek tu pun cair. Kemudian cepat-cepat la lect tu pecut. Nasib baik tak jadi apa-apa macam dalam movie2 seram kan??huhu...

Tak lama kemudian, basikal pun sampai. Cik Shira menyerahkan basikal kepada saya, dan berbasikallah saya dan Aisyah, melepasi kolej Taming Sari(lelaki) dan sampai je di kolej baru yang sedang menghitung hari je boleh masuk, saya mengajak Aisyah menjelajah ke sana...kolej 'Siluk Berlingkung', untuk pelajar-pelajar sem 6 perempuan dan pelajar lelaki junior. 

Tak pernah rasanya pelajar perempuan dan lelaki ditempatkan sekali macam ni. Asalnya kolej ini untuk lelaki, tapi disebabkan  tidak cukup kolej dengan kolej Nilam yang masih terbengkalai (renovate tak siap-siap lagi!) maka ramailah yang merempat, menyewa luar dan tak dapat kolej. Yang merempat tu pelajar sem 6 perempuan lah; seperti yang empunya tulisan ini... :""(( dan Intan, dip in Accountancy-Dekan setiap sem dan CgPA 3.87- pun tak dapat kolej. Katanya sem depan pelajar-pelajar perempuan sem 5 dan 6 pun dah tak terjamin tempat...setiap sem kemasukan akan banyak, dan sebelum ini penuntut lelaki sem 4 dan ke atas tak layak secara automatik menduduki kolej, mungkin sem seterusnya pelajar perempuan akan lalui perkara yang sama...hurmmm...

teringat awal-awal sem dulu planning nak menyewa sama-sama dengan Fatin dan Intan...Tapi tak lama kemudian Fatin dah dapat kolej dan Intan menyewa luar...macam-macam kami planning dan angan-angankan...huhu...walaupun housemate tak menjadi, kami tetap rapat sekarang, malah saya dan Fatin dah jadi macam P.I-mate...iaitu rakan masjid(Pusat Islam) sebab kami selalu tidur di Masjid ni bersama dan suka loyar buruk bersama juga... ;-)) Kami juga ada nama sendiri -FALAH-(Fatin&Adilah) terpinga-pingala orang kalau kami saling memanggil nama macam tu, kot-kotla cakap pasal persatuan Al-Falah yang mana Fatin adalah NYDP nya...huhu..pening3...

bersambung bab riadah....selesai pusing satu uitm berbasikal dan berjalan dengan aisyah, Intan, ruby, Jira, kak Hasan dan adik-adik pra, kami pun pulang ke Masjid As-Syakirin untuk mengambil barang masing-masing. Sempat dulu singgah di taman bersebelahan bangunan admin untuk bergambar sakan dan kemudiannya makan di benteng(kedai makan) kolej Taming Sari.  

Selepas itu?Asy-Syahidah lah semuanya kepenatan...huuu...petang pula saya dan kak Hasan ke perpustakaan  buat research dan study...harap-harap ada lagi peluang beriadah macam ni....bukan senang nak pegi ramai-ramai bergumbira sambil menyihatkan badan...Alhamdulillah...

Another Week.

Alhamdulillah....seminggu lagi minggu yang mencabar akan dilalui..siang tadi selesai presentation Entrepreneurship. Hebat betul dugaan yang dilalui untuk menyelesaikannya, ternyata saya tewas. Tewas dengan nafsu, tewas dengan syaitan durjana. Tewas dengan diri sendiri...

Ya Allah ampunilah hamba...

Law of Contract-Undue Influence

Question 5

One evening, Abu was told by his spiritual adviser Ali that their religious group urgently needed a new meeting place and Ali reminds Abu in a friendly way about his holiday resort, on being told to prayer for guidance, Abu announces that he is selling his villa resort to Ali at 10% of its actual value. Three days later Abu told his lawyers to transfer the villa to Ali. Two month later Abu was expelled from his religious group by Ali .He now want to set aside the sale of his villa resort. Advice Abu what kind of remedies are available to him.  

            According to the above situation, Ali is a spiritual adviser for Abu which is respected by him. Ali told Abu that they need a new meeting place and suggest Abu about his villa. Then Abu agreed to sell it to Ali at a lower price than actual value. A few months later Abu was barred from the religious group by Ali. He feel unsatisfied and want to set aside the contract.

Legal Issue:

•      Whether there is free consent of the contract?

•      Whether there is an undue influence element?

•      Whether Abu can claim remedies for the contract?

•      Whether the contract is void or voidable?

•      Whether there is an adequacy of consideration?

What Is Free Consent?

Free consent is one of the essential elements in the formation of a valid contract. Section 10(1) of the Contract Acts 1950 provides, “All agreements are contracts if they are made by free consent of parties...” This shows that the consent of the parties must be given freely and voluntarily.

What Constitute Consent?

Section 13 defines “Two or more person are said to consent when they are agree upon the same thing in the same sense.” It means that there must be a meeting of minds as to the nature and scope of the contract.

What Constitute Free Consent?

According to Section 14, “Consent is said to be free when it is not caused by coercion, undue influence, fraud, misrepresentation and mistake.” If one of the factors which are mentioned under Section 14 exists in the agreement, the consent is said to have been given without freely and voluntarily. Therefore the contract may become void or voidable (Zuramaznum, 2010).

What is void or voidable contracts?

Void – Section 2 (g) defines “an agreement not enforceable by law is said to be void”

According to the act, no rights given to the parties, and no obligations imposed on them and the contract cannot be enforced at all, even by the court.  

Voidable – Under Section 2 (i), “An agreement which is enforceable by law at the option of one or more of the parties thereto, but not at the option of the other or others, is a voidable contract”.  

Elements that may effects the ‘free consent’

1. Coercion
2. Undue influence
3. Fraud
4. Misrepresentation
5. Mistake

In this situation the cases has been affected by undue influence element.

What Is Undue Influence?

Undue influence happen when one of the parties to a contract, entered such contract by the influence of the other party who was able to influence him. Section 16(1) gives the elements of undue influence: ‘A contract is said to be induced by “undue influence” where the relations subsisting between the parties are such that one of the parties is in position to dominate the will of the other and uses that position to obtain an unfair advantage over the other.’

            Under this section, there are two essential ingredients in order to claim that there is ‘undue influence’ in a contract. Firstly they are the domination of the will by one party over the other party. Secondly the dominating party obtains an unfair advantage in the contract. For example in illustration (c) section 16, “A, being in debt to B, the moneylender of his village, contracts a fresh loan on terms which appear to be unconscionable. It lies on B to prove that the contract was not induced by undue influence.”

The Conditions To Be Fulfilled In Order To Rescind A Contract Due To ‘Undue Influence’.

            To rescind a contract by reason of undue influence, plaintiff must establish that the agreement was being ‘unconscionable’ by proving firstly, there is a relation between the contracting parties; where one of them naturally relied upon the other for advice, help and the like and the other was in a position to dominate the will of the first party. Secondly, the person in the position of domination has used that position to obtain an unfair advantage for himself and causing loss or injury to the other party as in illustration (c) to section 16 above. When those two mentioned requirements have been proved by the plaintiff then the dominant party (defendant) has to prove that no domination was done to tempt the other party to enter into the contract. If the dominant party (defendant) failed to do so, the contract therefore may be rescinded on the ground of ‘undue influence’. This may be referred to section 16 (3) (a); “Where a person who is in a position to dominate the will of another, enters into a contract with him, and the transaction

appears, on the face of it or on the evidence adduced, to be unconscionable, the burden of proving that the contract was not induced by undue influence shall lie upon the person in a position to dominate the will of the other.”

Presumption Of Domination

            In certain circumstances, a party is deemed by law to be in position that can dominate the will of another. The circumstances are provided under section 16 (2) (a) and (b), “..a person is deemed to be in a position to dominate the will of another…

(a) where he holds a real or apparent authority over the other, or where he stands in a fiduciary relation to the other; or

(b) where he makes a contract with a person whose mental capacity is temporarily or permanently affected by reason of age, illness, or mental or bodily distress.

The Effect Of ‘Undue Influence’ In A Contract

Section 20 of the Contract Acts 1950 provided that “When consent to an agreement is caused by undue influence, the agreement is a contract voidable at the option of the party whose consent was so caused. Any such contract may be set aside either absolutely...” If the defendant failed to rebut the proof or presumption of undue influence, the contract is voidable.
